Global Implications of Patent Law Variation

A patent is an exclusive right to use an invention for a certain period of time, which is given to an inventor as compensation for disclosure of an invention. Although it would be beneficial for the world economy to have uniform patent laws, each country has its own laws designed to protect domestic inventions and safeguard technology. Despite widespread variation, patent laws generally fall under one of two principles: the first-to-file and first-to-invent. The first-to-file principle awards a patent to the person or institution that applies for a patent first, while the first-to-invent principle grants the patent to the person or institution that was first to invent – and can prove it. Most countries have adopted the first-to-file system. However, the United States maintains a first-to-invent system, despite obvious shortcomings. A result of countries employing different patent law principles is inconsistency of patent ownership.

Patent ownership is not recognized globally. On the contrary, ownership may change depending on the country. It is not uncommon for an invention to have two patent owners – one in the United States and one in the rest of the world. This unclear ownership often has economic consequences. If a company is interested in using a patented invention, it may be unable to receive permission from both patent owners, which in turn may prevent manufacture of a particular product. Even if permission is received from both owners, paying royalties to both may be quite costly. In this case, if the invention is useful enough, a company may proceed and pass on the added cost to consumers.

International economic tension has also been increasing as a result of differing policies. Many foreign individuals and companies believe that they are at a serious disadvantage in the United States with regard to patent ownership because of the logistical difficulties in establishing first-to-invent status. Further, failure of the United States to recognize patent ownership in other countries is in violation of the Paris Conventions on Industrial Properties, which requires all member nations to treat all patents equally. The conflict surrounding patents has prompted the World Intellectual Properties Organization (WIPO) to lobby for universality in patent laws. WIPO maintains that the first necessary step involves compelling the United States to reexamine its patent principle, taking into account the reality of a global economy. This push may indeed result in more global economic cooperation.

Writing the Summary:

When writing the summary there are three main requirements:
1. The summary should cover the original as a whole.
2. The material should be presented in a neutral fashion.
3. The summary should be a condensed version of the material, presented in your own
words.
* Also do not include anything that does not appear in the original. (Do not include your own comments or evaluation.) and be sure to identify your source.


For example:
In his paper “Global Implications of Patent Law Variation,” Koji Suzuki (1991) states that lack of consistency in the world’s patent laws is a serious problem. My son who has dyslexia is one of the lucky children who have been given a chance in this national pioneering programme to support children with dyslexia.
Some children with dyslexia are perceived as dreamers or naughty and disruptive at school. The pilot programme at my son’s school was designed for 16 children with the support of three Special Education teachers. The children in the pilot programme seem to be isolated, not physically but socially, from the other children and at times also the teachers in the school. Research has shown that children with learning difficulties need various kinds of support throughout their school years.

Summarizing (Topic Dyslexia)
Dyslexia is a condition which affects an individual’s ability to have communication difficulties and also have problems distinguishing left from right. Beside that, it also affect the child’s handwriting and numeracy skills or the ability to memorise items in sequential order. However, it does not affect an individual’s intellectual ability. From that, children with dyslexia are intellectually “normal”, but have unusual and unexpected difficulty in learning to read and spell. On the other hand, children with dyslexia are perceived as dreamers or naughty and disruptive at school. Moreover, a child with dyslexia has to concentrate a great deal harder to understand what is written in front of him, as a result of this, he may become very tired and sometimes irritable.

Dear students,

Before attempting to write a summary, you must first read the article thoroughly and understand it. Only then would you be able to identify what the main ideas (important points) are and exclude details and definitions.

In this particular article, the author has highlighted the necessary steps to be taken to help sustain and improve secondary schools that cater to dyslexia students. Focus on this idea. Pick out anything that contains this particular idea.

However, it does not affect an individual’s intellectual ability. The Education Ministry launched a pilot dyslexia programme. Initially 30 schools were earmarked for the project which causes the overcrowding in the pilot school. At the World Assessment Exposition held at Putra World Trade Centre, the Malaysian Examination Board demonstrated the SIBKOM, a computer-aided interactive programme. The UPSR questions need to be programmed into the SIBKOM for dyslexia students. We hope that the Education Ministry will reconsider its project at secondary school level for dyslexia children. More Special Education teachers are needed to provide educational and moral support, for these children need to build confidence to face the future.

Dyslexia is the most common of learning disability.it affect an individual’s ability to read and spell. A child with dyslexia may display communication problem and have problem to different between left and right.it also affect the handwriting and confusing when see a symbol. A child with dyslexia is harder to understand what is written in front of him,thus can cause very tired and irritable when hard to understand what is written. Statistics show that as many as 10% of students in primary schools are still not able to read after having gone through six years of primary education. It is possible that a percentage of these children may have undetected dyslexia. The statistics did not state whether the non-readers were assessed to evaluate why they could not read.

The Education Ministry launched a pilot dyslexia programme. Initially 30 schools were reserved for the project. However, due to the bad response, this programme was unable to enforce in all the 30 schools. The first batch of children in this project will sit for their UPSR next year. In order to show how the programme works, the Examination Board had demonstrated the SIBKOM to the public, at Putra World Trade Centre in May. Cho’s family was some of the visitors of this exposition. His son, who has been given a chance in national pioneering programme, has tried out the SIBKOM. The whole process of this programme is computerised. Children no need to shade the answer on the test papers, which is exhausting and difficult to distinguish for those with dyslexia. Cho hopes that the Education Ministry will reconsider its plans and continue the project at secondary school level for the sake of children.

In her paper “More support needed” CHO SUET SEN(2006), states that the need for continued support for dyslexic children in our secondary education system. The project is not fully carried out as planned before as there is lack of response from some of the schools or parents. In addition, there is also lack of teaching support. The programme should be carried out in more inclusive way, so that the children are not isolated from other children socially. Peer support is another important element for them as well. Support in term of equipments should be given for dyslexic children in order to help them in doing their exam. Some effort should be made to produce software product that is suit for the children. Various kind of support should be given throughout the school year and also early detection programmes should be implemented in government school. There should be effort to increase the number of well-trained Special Education teachers.

In his paper “ support for children with Dyslexia in secondary education system(2006)”, Cho Suet Sen states that support program for children with Dyslexia was not carry out due to the negative response from certain parties. Thus, this problem herded in the pilot school. Apart from that, peer support and improving the program more inclusive are important to reduce the social problem between children . In May 2006, Malaysian Examination Board have established a computer-aided interactive program( SIBKOM).In this program, the whole process is computerized and it has advantageous them indirectly. But, So far, education ministry still into two minds to continue the program due to some reasons. Hopefully good response will be hearing soon from education ministry to help some children with Dyslexia rapidly.

Cho Suet Sen states that more support needed for those children with dyslexia in our secondary education system. The Education Ministry launched a pilot dyslexia programme in many schools. Due to the lack of response, the problem of overcrowding happens in the pilot school. Cho Suet Sen also states that the pilot programme was actually lack of manpower such as teachers. She also points out that the way to tabulate the mark should be more considerative to these kind of children. The pilot programme was initiate with good intention; but without the further support from others, those unlucky children will be suffering in future.

As been talk about in the “More Support Needed” article by Cho Suet Sen, Dyslexia is a symptoms that’s influence an individual’s capability to make a good progress whether in reading or writing skills. But, this type of condition does not bother the children intelligence and that make these group of children is a “normal” person that can thoughts just like us. Thus, they need to focus and understand what is written for them otherwise they will become exhausted and irritable. In the other hand, peer support is very important to help these children as they also need friends. In May 2006. Malaysian Examination Board introduced the SIBKOM, a method that can help these children in their examination by just hearing and click to their the answer. Hopefully with this type of assist, these children can grow as well as other children in this world.

Cho Suet Sen was glad that the pilot dyslexia programme was launched as his son is having dyslexia and 30 schools was earmarked for this programme. Dyslexia is a condition where it affects an individual’s reading, understanding, spelling and more. Due to thethe problem of lacking response it faces the problem of overcrowding and short of manpower. Cho Suet Sen’s son tired the SIBKOM, a computer aided programme where it is used in the coming UPSR exam. This programme shows the questions and answers and read it out. Cho Suet Sen is hoping that SIBKOM will be ready as soon as possible. Statistic shows that 10% of the weak students in the nation have undetected dyslexia.

Cho Suet Sen felt very happy that her son include in the pilot dyslexia program that support children with dyslexia. Although there are 30 schools were earmarked for this project, some authorities did not show their responsibility in this project .Thus, this program was not probably organized. The Malaysian Examination Board demonstrated the SIBKOM, a computer-aided interactive program that make her son who will sit for the UPSR examination soon very excited because the questions were being read out to him. Through this program, dyslexia’s students no need to shade their answer on the test papers, which is bring tiring and difficult to them. In “More Support Needed”, Cho Suet Sen stats that dyslexia affects abilities of an individual. They needed supports in secondary secondary school and from peers. However, Education Ministry had launched a pilot dyslexia programme for these individual in June 2004. But this programme failure due to parents and schools cold responses. Malaysian Examination Board (Lembaga Peperiksaan) demonstrated the SIBKOM, a computer-aided interactive programme. SIBKOM received a good response from those individuals, but this SIBKOM must be consider by Ministry Education before implemented. Many students are still not able to read after six years of primary school. They may have undetected dyslexia. Hope more Special Education teacher will involve in this programme to build their confidence.

Symbols can appear confusing to the child too. The pilot programme at my son’s school was designed for 16 children with the support of three Special Education teachers. The children in the pilot programme seem to be isolated socially, from the other children and at times also the teachers in the school. However, there is a sense of camaraderie among the children with dyslexia.The World Assessment Exposition ,the Malaysian Examination Board , demonstrated the SIBKOM. Sample questions were given for this testing.It is possible that a percentage of these children may have undetected dyslexia.

The pilot programme at SK TTDI(2) was planned for 16 children with the uphold of three Special Education teachers. Research has shown that children with hardship in learning need different types of support in their school years. More than 10% of students in primary school are still unable to read after six years of primary education. Parents of this pilot programme do not know what to do with their children after the UPSR.

It is no affects on intellectual skill, however, affects in individual’s reading ,spelling ,handwriting,and numeracy skill. This Programme already was earmarked in 30 school but it is fail because of lack of reason from school and parents. Besides that, pilot school also overcrowding with this problem. To get a trust among student with the dyslexia, peer supports are need for those children. Statistics show that student cant read after gone six years of primary education may have undetected dyslexia. So, SIBKOM was demonstrated by Malaysian Examination Board (Lembaga Peperiksaan) to easily student understand questions. For students are need confidence, educational and moral support are need to provide.

Hence, the problem of overcrowding in the pilot school encountered. Furthermore, the Special Education teachers need more teaching support to ensure the dyslexia student to do better. Peer support is very important for dyslexia children to counter this problem; Education Ministry had created a SIBKOM system to enable dyslexia children answer their exam questions easier. However, Education Ministry just gives support to dyslexia kids in the primary school. Throughout their school years, dyslexia children need various kinds of support. Parents of child who has dyslexia should feel glad when the Education Ministry launched a pilot dyslexia programme at schools. Dyslexia is a condition which affects an individual’s ability to reading. However not all 30 schools that were earmarked for this project are plemented due to the lack of response. The author’s son who has dyslexia involve in the pilot programme with others 28 children with two special education teachers. The Malaysian Examination Board (Lembaga Peperiksaan) demonstrated the SIBKOM, to help the Dyslexia children in their studying.
The authors hope that the Education Ministry will reconsider its plans and continue the project at secondary school level for her children. More Special Education teachers are needed to provide educational and moral support, for these children need to build confidence to face the future.
